Over the years some in America have worked diligently to infringe upon or downright deny Constitutional rights to everyday Americans. While at the same time employing all sorts of methods to extend Constitutional rights to non-Americans, enemy combatants and even terrorist captured here and abroad. Below are just a few examples of lies and facts as they pertain to our Constitution.
LIE; All terrorist should be tried in criminal courts because military tribunals are illegal and unconstitutional.
TRUTH; The Constitution clearly allows for tribunals.
PROOF; Article I Section 8 Subsection 9 (Powers Granted to Congress) reads: To constitute Tribunals inferior to the Supreme Court;
LIE; Terrorist and enemy combatants, who are not U.S. citizens, captured here and abroad have a “RIGHT” to Habeas Corpus. (A writ of Habeas Corpus is a judicial mandate requiring that a prisoner be brought before the court to determine whether the government has a right to continue detaining them. The individual being held or their representative can petition for such a writ.)
TRUTH; You and I, even as American citizens, do not have a “right” to Habeas Corpus. The Constitution clearly calls it a privilege.
PROOF; Article I Section 9 Subsection 2 (Powers Forbidden to Congress) reads: The privilege of the Writ of Habeas Corpus shall not be suspended, unless in Cases of Rebellion or Invasion the public Safety may require it.
LIE; Terrorist, who are not U.S. citizens, captured here or abroad are entitled to protection under the U.S. Constitution.
TRUTH; These people are clearly not entitled to these protections.
PROOF; The Preamble to the Constitution reads: We the People of the United Stated, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish the Constitution for the United States of America.
LIE; The executive branch, at the discretion of the President, can have oversight of the census.
TRUTH; Only Congress has census oversight.
PROOF; Article I Section 2 Subsection 3 (The Legislative Branch) reads: The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.
LIE; The United States of America is one, all inclusive, entity. And, what applies to one state also applies to the other forty nine.
TRUTH; The United States of America is a Republic. It is a confederation or union of individual states. Each state’s sovereignty is protected by the Constitution. Citizens in every state have duel sovereignty. One under their respective state’s Constitution and the second under the U.S. Constitution. A law and or federal court ruling in one state is not necessarily binding in any other state. As a matter of fact, since 2008 nine states have declared their sovereignty. Before everything is said and done it is expected that this list of states will grow to twenty two. These nine states are New Hampshire, Washington, Georgia, Arizona, California, Missouri, Michigan, Montana and Oklahoma.
PROOF; Article IV Section 4 reads: The United States shall guarantee to every State of this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive when the Legislature cannot be convened against domestic Violence. Article X of the Bill of Rights reads; Article III Section 2 Subsection 1 reads: The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority; And Article III Section 3 Subsection 3 reads: Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies.
LIE; The Constitution calls for an absolute separation between church and state.
TRUTH; The words “separation of church and state” DO NOT appear anywhere in the Constitution. Over the years, progressives along with activist judges have taken the establishment clause and used it as a catalyst to establish a freedom “from” religion. Not the freedom “of” religion guaranteed in the Constitution. The Constitution prevents Congress from establishing a “national religion” similar to the Anglican Church (also known as the Church of England). The Church of England and it’s persecution of Christians is why the Puritans fled to America in the first place.
PROOF; Article I of the Bill of Rights reads: Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people to peaceably assemble, and to petition the Government for a redress of grievances.
LIE; The United States is a democracy.
TRUTH; The United States is not a democracy. It is a representative republic and was established on a republican form or government. Remember this? “I pledge allegiance to the flag of the United States of America and to the republic for which it stands.” Thomas Jefferson once wrote “Democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.”
PROOF; Article IV Section 4 reads: The United States shall guarantee to every State of this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive when the Legislature cannot be convened against domestic Violence.
LIE; The federal government is structured like a company and our President is the CEO and the Congress is the board of directors. The ultimate authority over the people belongs to the federal government. And, the federal government has the final decision on all matters. Even state governors are subservient to the President.
TRUTH; The federal government only has the powers that are specifically listed in the Constitution. All the power it has grabbed is illegal and unconstitutional. The real earthly authority belongs to each state, but ONLY once that authority has been ceded to that state but the PEOPLE of that state. Remember, nine states have reasserted their authority and sovereignty. The state of Oklahoma’s Proclamation reads in part “that this serve as notice and demand to the federal government, as our agent, to cease and desist, effectively immediately, mandates that are beyond the scope of these constitutionally delegated powers.”
PROOF; Article IX of the Bill of Rights reads: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. Article X of the Bill of Rights reads: The powers not delegated to the United Sates by the Constitution, or prohibited by it to the States, are reserved to the States respectively, or to the people.
